| DALTON TOWNSHIP SPECIAL BOARD MEETING-MAY 30, 2006
7:00 P.M.
BOARD MEMBERS PRESENT: Scott Hladki, Mary Ellen Sherwood, Rosemary Rinella, Mike Hiner, Elizabeth (Petsy) Jenkins, Diane Misze and Lynn Young.
BOARD MEMBERS ABSENT: None.
Supervisor, Scott Hladki, called the meeting to order at the Dalton Township Hall.
Motion by Mary Ellen, support by Mike, PASSED to open the public hearing as posted and advertised for the confirmation of the special assessment roll for sanitary sewer on River and Whitehall Roads. Yes: Mary Ellen, Mike, Diane, Lynn, Petsy, Rosemary and Scott. No: none.
The following residents/business owners were present to express their disapproval of the sanitary sewer special assessment and signed the sign in sheet which represents their right to possibility appeal their special assessment to the Michigan Tax Tribunal before the deadline. William Beegle, Gerald Vanhassel, Milton Fiser, Floyd Wilbur, Cory and Susan Burmeister, Tammy McDaniel, Steve McDaniel, Bud Fiser, Carl Lundholm, Carol Anderson, Manuel Sahagun, Audrey Thompson, Mike Brown, Fred and Christopher Liebertz, Brian Avdek.
Camille Jourdan-Mark was present on behalf of Michigan Adventure and questioned since they are in both Dalton and Fruitland Townships how does this affect their being specially assessed by Dalton for the sanitary sewer when most of the sewage would be generated in Fruitland. The attorney stated that Fruitland Township does not have the sewer utilities available to offer connections; therefore, Dalton will provide the sewer and Fruitland cannot charge them for service that they already have, or stated differently, Fruitland cannot reassess a benefit already provided. The attorney stated that Fruitland Township may wish to bill Michigan Adventure for sewer usage. Many questions and concerns were presented by those present. Mr. Brumm of Woodworkers Unlimited and C & M Storage, was present to question the number of REU's calculated at this business. The attorney stated that the number of REU's at this address does seem excessive and stated that the roll can still be confirmed as we still have the ability to correct errors.
Motion by Diane, support by Mike, PASSED to close the public hearing. Yes: Diane, Mike, Diane, Lynn, Petsy, Rosemary, Mary Ellen and Scott. No: none.
Motion by Mike, support by Rosemary, PASSED to confirm the Special Assessment Roll as presented, with the ability to correct any possible errors. Yes: Mike, Rosemary, Diane, Lynn, Petsy, Mary Ellen and Scott. No: none. Petsy stated that it is inevitable that the water and sewer is coming, and this is the best price that will be available; Mary Ellen agreed.
WATER RESOLUTION SETTING THE HEARING ON THE S. A. ROLL:
Motion by Mike, support by Petsy, PASSED to approve the Resolution setting the date of June 19, 2006 at 7:00 p.m., to hold a public hearing, and to confirm the Special Assessment Roll for water improvements affecting properties abutting Agard Road on the north between Hamilton and Whitehall Roads; properties abutting Whitehall Road between Agard Road and McMillan Roads, properties abutting Hamilton Road between Agard Road and McMillian Road; and properties abutting Blair Road between Keller and McMillan Roads.
