DALTON TOWNSHIP SPECIAL BOARD MEETING-JANUARY 26, 2009, 4:30 P.M.
BOARD MEMBERS PRESENT: Chris Hall, Mary Ellen Sherwood, Elizabeth (Petsy) Jenkins, Mike Hiner, Merle H. Hittle, James Lothschutz, and Ross McCloskey. (Mike left the meeting at 5:20.)
BOARD MEMBERS ABSENT: None.
Supervisor, Chris Hall, called the meeting to order at the Dalton Township Hall. The Pledge of Allegiance said, invocation given, and roll call taken.
PUBLIC COMMENTS:
None.
LEAVE OF ABSENCE FOR MAINTENANCE SUPERVISOR:
Motion by Mary Ellen, support by Mike, PASSED to approve the leave of absence as requested for the Maintenance Supervisor from Monday, March 23 through Tuesday, March 31, 2009. Yes: All.
LEGAL AGREEMENT FOR APPRAISER SERVICE:
Chris stated that Brian Beatty, the Appraiser that the Township hired for appraisals for the properties in litigation in the tax tribunal cases, has changed his place of employment and is now with another company. Chris stated that this appraiser will most likely be testifying at the upcoming trials for the tax tribunal cases; therefore, the board needs to approve the appraisals services under the new company name.
Motion by Mike, support by Ross, PASSED to allow the Supervisor, Chris Hall, to sign the Agreement for the appraiser's services. Yes: All.
REVIEW EMPLOYEE POLICY:
Board members reviewed the Personnel Policy and changes were suggested. Some employees and the public that was present made comments and suggestions regarding this document as well. The review will be ongoing for the personnel policy. Another special meeting will be set for future review of this document. No action was taken.

CLOSED SESSION-PENDING LITIGATION, TAX TRIBUNAL CASES:
At 5:45 p.m., Motion by Merle, support by Ross, PASSED to enter into closed session to discuss pending litigation cases in the tax tribunal with Attorney, Josh Wease. Yes: Merle, Ross, James, Petsy, Mary Ellen, and Chris. No: none. Absent: Mike left the meeting prior to this vote.
At 8:00 p.m., Motion by Ross, support by Merle, PASSED to enter back into the open meeting. Yes: Ross, Merle, James, Petsy, Mary Ellen, and Chris. No: none. Absent: Mike left the meeting prior to this vote.
Motion by Merle, support by Mary Ellen, PASSED to give the Township Tax Tribunal Attorney, Josh Wease, the authority to negotiate with VanHassell, Woodworks Unlimited, and C & M Storage with regard to the sewer special assessments on Whitehall Road. Any negotiations will be brought back to the board for consideration and/or final approval. Yes: Merle, Mary Ellen, Ross, James, Petsy, and Chris. No: none. Absent: Mike left the meeting prior to this vote.
